Types of Pedestrian Accidents

Pedestrian-Vehicle Collisions

The most common types of traffic accidents involve pedestrians hit by a car. These happen when a pedestrian is struck by a motor vehicle while crossing the street or walking along the side of the road. Pedestrian-vehicle collisions occur from a variety of factors, including driver distraction, speeding, failing to yield the right-of-way, impaired driving, and failing to obey traffic signs and signals.

Dooring Accidents

A phenomenon known as “dooring.” Dooring occurs when a driver or passenger opens a vehicle door without checking for oncoming cyclists or pedestrians. This can cause the cyclist or pedestrian to swerve into traffic to avoid the open door. Dooring accidents result in serious injuries and fatalities and are especially common in areas with heavy bicycle traffic.

Pedestrian-Bicycle Collisions

These types of accidents can occur in urban areas, on sidewalks, and even in crosswalks. With the prevalence of today’s speedy electric bikes, pedestrian/bicycle collisions can cause serious injuries, including head and neck trauma, as well as broken bones.

Common Pedestrian Accident Injuries

Pedestrians suffer many of the types of injuries also experienced by vehicle occupants involved in collisions, but the injuries incurred by people hit by a car while walking tend to be debilitating. Some of the most common injuries suffered in pedestrian accidents include:

  • Spinal Cord Injuries: Injuries to the spinal cord often have long-term disabling consequences because this vital part of the body transmits signals between the brain and body.
  • Brain Injuries and TBIs: Traumatic brain injuries can range from mild concussions to life-altering brain damage. They occur when the head suddenly hits an object or if the skull is pierced.
  • Internal Bleeding: Internal bleeding can impact the whole body. Upon the impact of the accident, blood vessels can rupture or be damaged. Internal bleeding is life-threatening, and symptoms may not occur.
  • Neck Injuries: Neck injuries can include strained muscles, herniated discs, nerve damage, and cervical fractures. These injuries often cause chronic pain and may interfere with daily activities and work.
  • Paraplegia: Paraplegia is the loss of function of the lower limbs. The force of a truck accident can cause severe injuries to the neck or back, leading to compression, crushing, or fractures.
  • Concussion: A concussion is a TBI caused by a blow or jolt to the head. Symptoms often include headaches, dizziness, confusion, and memory issues.
  • Brain Bleed: A brain bleed is a serious injury that occurs when bleeding develops in or around the brain after trauma, leading to life-threatening complications.
  • Broken Bones: High-impact accidents between a vehicle and a pedestrian can cause broken bones in any part of the body, such as the hips, ribs, and legs. Breaks can require casting, surgery, or physical therapy.
  • Cervical Strain: A cervical strain is an injury to the muscles or tendons in the neck, often caused by sudden movement during a collision. Symptoms typically include neck pain, stiffness, and reduced range of motion.

Frequently Asked Questions

How long do I have to file?

Not much. The time limit for filing a personal injury claim in the state of Arizona depends on the type of case and if the case will be filed against a government agency or municipality.  In most personal injury cases, a claimant has two years from the date of the accident to file a claim against the at-fault party. The statute of limitations are explained in A.R.S. § 12-541 et seq.  If the claimant is filing against a municipality or government agency, the time to file may be only six months. Failing to file your claim within the applicable statute of limitations is likely to terminate your right for recovery.

What if I was outside a crosswalk or partially at fault?

Arizona’s pure comparative negligence still allows recovery. Your compensation is reduced by your percentage of fault. Don’t assume you don’t have a case, let us evaluate the facts.

Do I have a claim if the driver fled or had no insurance?

Often, yes. We can pursue Uninsured Motorist (UM)/ Underinsured Motorist (UIM) coverage and investigate other responsible parties.

Who pays my medical bills while the case is pending?

We coordinate benefits (health insurance, med-pay, liens) and pursue reimbursement as part of your settlement or verdict.
