What Qualifies as a “Boating Accident” in Arizona?

If a collision/capsize/ejection causes death, disappearance, injury beyond first aid, or property damage (Arizona uses a $500 reporting threshold), it must be reported to Arizona Game & Fishwithin 48 hours if there’s death/serious injury and within five days for other qualifying events.

“Accident” is the reporting term. In our advocacy, we call it what it is: a preventable crash, usually caused by choices on the water.

How Boating Crashes Happen

  • Operator impairment/distraction (alcohol, drugs, phones, music, GPS)
  • Excess speed / reckless maneuvers in crowded coves and narrow channels
  • Inexperience / rental operators unfamiliar with local waters and traffic rules
  • Overloaded or improperly secured cargo / tow sports
  • Maintenance failures (brakes on trailers, steering/throttle issues, lighting)
  • Hazards & poor markings (submerged objects, unlit buoys, sudden weather)

Liability may reach the operator, rental or tour companies, owners, maintenance providers, manufacturers (defects), and in some cases public entities responsible for dangerous conditions

What “It’s Personal” Means to the People We’ve Helped

Grand Canyon River Rafting Accidents

Rafting through the Grand Canyon is one of Arizona’s most breathtaking adventures, but when a trip downriver turns tragic, we’re here to help. Even with signed waivers, rafting companies can still be held accountable if negligence played a role. Equipment failures, poorly trained guides, or inadequate safety briefings can all turn a scenic float into a preventable disaster.

Glen Canyon Rafting and Tour Accidents

Glen Canyon offers stunning waterways and challenging rapids, but accidents here can be severe. Common injuries include broken bones, head trauma, and near-drowning events, often caused by faulty gear, dangerous conditions, or untrained operators.

Holding Negligent Operators Accountable

Rafting companies, tour guides, and equipment providers all have a duty to keep participants safe. When that duty is breached, through poor training, defective rafts, or ignoring known hazards. Operators can be held liable despite “assumption of risk” waivers.

With over two decades of experience handling complex water and recreation injury claims, from the Grand Canyon to Glen Canyon and every Arizona waterway in between, Torgenson Law brings deep knowledge of boating and recreation law and the same relentless advocacy that defines our firm. It’s personal and we fight like it.

What Arizona Law Says

OUI/BUI (Boating Under the Influence): Arizona makes it illegal to operate a motorized watercraft at or above 0.08 BAC within two hours of operation; drug impairment also qualifies. Commercial operators face tighter limits.

Comparative negligence (pure): you can recover even if you’re partly at fault; compensation is reduced by your percentage.

Deadlines: Most injury claims must be filed within two years; government-related claims require a Notice of Claim within 180 days and suit within a year. Don’t miss these—rights can be lost.

What to Do Right Now

  1. Get medical care and follow through—adrenaline masks injuries.
  2. Preserve evidence: photos/video, witness contacts, tow/repair docs, rental contracts, life jackets, damaged gear.
  3. Don’t give recorded statements or broad medical releases to insurers.
  4. Call us. We take over communications and issue preservation letters immediately.
